La gestión del Ministerio de Relaciones Exteriores y Culto en materia de derechos humanos: alcances y limitaciones (1987-1998)

Abstract

En este documento, se integran los resultados de una investigación realizada para optar al grado académico de Magister en Relaciones Internacionales y Diplomacia con énfasis en Administración de Proyectos de Cooperación Internacional. El tema que motivó esta tesis fueron los alcances y las limitaciones de la gestión del Ministerio de Relaciones Exteriores y Culto en materia de Derecho Humanos durante el período 1987-1998. La investigación pretende dar respuesta, fundamentalmente, a ¿cuáles han sido los elementos que han intervenido en los logros y las limitaciones de la gestión de la política exterior de Costa Rica en materia de Derechos Humanos sustentada en los foros internacionales multilaterales? El interés principal en este estudio estriba en dar a conocer el proceso de gestión de la política exterior costarricense en el ámbito de los derechos humanos y de su articulación interna, con respecto a la evolución de los procesos de toma de decisiones de políticas exterior, producto de los cambios trascendentales y la complejidad alcanzada en la agenda global de las relaciones internacionales, concretamente en el campo de los Derechos Humanos. Esta investigación se respalde en los siguientes capítulos: Capítulo 1. “Contexto histórico del origen del Departamento de Derecho Humanos en el Ministerio de Relaciones Exteriores y Culto”. En este capítulo se analiza el contexto histórico internacional, regional y nacional así como los motivos que influyeron en la creación de una área especializada en este campo en el Ministerio de Relaciones Exteriores y Culto; el proceso de toma de decisiones y los elementos básicos constitutivos de esta unidad, a los cuales hace referencia Snyder y Sapin en la “Teoría de las Decisiones”, a saber: tamaño, estructura, situación en el marco institucional, relaciones con otras unidades de la organización, duración y objetivos. Capítulo II. “Ámbitos de la Política Exterior Multilateral en materia de Derechos Humanos: la ONU y la OEA”. Para ubicar y comprender la gestión de la política exterior multilateral y de la diplomacia costarricense en esta área, fue necesario describir los órganos, organismos especializados y otras organizaciones del sistema de las Naciones Unidas y del sistema interamericano que se ocupan del fomento y la protección de los derechos humanos. La información contenida en este capítulo puso de manifiesto la complejidad y el grado de especialización que requiere el tratamiento de estos temas de la agenda de ambas organizaciones. Capítulo III. “La Gestión de otros Ministerios de Relaciones Exteriores latinoamericanos en materia de Derechos Humanos”. Destaca los procesos y los mecanismos de gestión en esta área utilizados por las Cancillerías de Colombia, Ecuador, Chile, República Dominicana y Venezuela. La intención es mostrar los avances y el interés existente en la adopción de medidas concretas, por algunos de estos Ministerios, para procurar un cumplimiento efectivo de los compromisos internacionales adquiridos por el Estado en este campo. Capítulo IV. “Análisis: Alcances y Limitaciones de la gestión del Ministerio de Relaciones Exteriores y Culto en materia de Derechos Humanos”. Contiene el análisis de los elementos que han incidido en los logros y las limitaciones de la gestión de la política exterior costarricense de promoción y defensa de los Derechos Humanos así como el origen de las iniciativas presentadas en los foros internacionales entre 1987 y 1998. Capítulo V. “Conclusiones”. No ha habido una evolución en los mecanismos de gestión de la política exterior costarricense de Derecho Humanos acorde con el avance y el grado de complejidad de la agenda internacional respecto a los temas de Derecho Humanos. “Recomendaciones”. Considerando la evolución que ha experimentado el proceso de gestión de políticas exterior concerniente a los Derechos Humanos, producto de los cambios ocurridos en la agenda internacional en esta esfera, el Ministerio de Relaciones Exteriores y Culto debería establecer una Comisión de carácter interministerial para atender los compromisos internacionales de Costa Rica en materia de Derecho Humanos y proveer, al Área de Derechos Humanos, de los recursos humanos especializados y materiales necesarios para el cumplimiento efectivo de sus funciones.

This document integrates the results of a research carried out for the academic degree of Master in International Relations and Diplomacy with emphasis on International Cooperation Project Management. The topic that motivated this thesis was the scope and limitations of the management of the Ministry of Foreign Affairs and Worship in the field of Human Rights during the period 1987-1998. The research seeks to answer, fundamentally, what have been the elements that have intervened in the achievements and limitations of the management of Costa Rica's foreign policy in the area of Human Rights sustained in multilateral international forums? The main interest in this study lies in making known the process of Costa Rican foreign policy management in the field of human rights and its internal articulation, with respect to the evolution of foreign policy decision-making processes, as a result of the transcendental changes and the complexity reached in the global agenda of international relations, specifically in the field of Human Rights. This research is supported by the following chapters: Chapter 1. "Historical context of the origin of the Human Rights Department in the Ministry of Foreign Affairs and Worship". This chapter analyzes the international, regional and national historical context as well as the reasons that influenced the creation of an area specialized in this field in the Ministry of Foreign Affairs and Worship; the decision-making process and the basic constitutive elements of this unit, referred to by Snyder and Sapin in the "Theory of Decisions", namely: size, structure, situation in the institutional framework, relations with other units of the organization, duration and objectives. Chapter II. "Spheres of Multilateral Foreign Policy on Human Rights: the UN and the OAS". In order to locate and understand the management of multilateral foreign policy and Costa Rican diplomacy in this area, it was necessary to describe the organs, specialized agencies and other organizations of the United Nations system and the Inter-American system that deal with the promotion and protection of human rights. The information contained in this chapter revealed the complexity and degree of specialization required to deal with these issues on the agenda of both organizations. Chapter III. "The Management of other Latin American Ministries of Foreign Affairs in the area of Human Rights". It highlights the processes and management mechanisms in this area used by the Ministries of Foreign Affairs of Colombia, Ecuador, Chile, Dominican Republic and Venezuela. The intention is to show the progress and interest in the adoption of concrete measures, by some of these Ministries, to ensure effective compliance with the international commitments acquired by the State in this field. Chapter IV. "Analysis: Scope and Limitations of the management of the Ministry of Foreign Affairs and Worship in the field of Human Rights". It contains the analysis of the elements that have influenced the achievements and limitations of the management of the Costa Rican foreign policy for the promotion and defense of Human Rights, as well as the origin of the initiatives presented in international forums between 1987 and 1998. Chapter V. "Conclusions". There has been no evolution in the mechanisms for the management of Costa Rican foreign policy on human rights in accordance with the progress and degree of complexity of the international agenda with respect to human rights issues. "Recommendations". Considering the evolution that the foreign policy management process concerning human rights has undergone, as a result of the changes that have occurred in the international agenda in this area, the Ministry of Foreign Affairs and Worship should establish an inter-ministerial Commission to attend to Costa Rica's international commitments in the area of human rights and provide the Human Rights Area with the specialized human and material resources necessary for the effective fulfillment of its functions.
