Estrategia para el Poder Judicial de Costa Rica, enfocada a la atracción de recursos de la cooperación internacional para el desarrollo de proyectos de gobierno abierto, en el período 2016-2018

Abstract

El presente trabajo de investigación busca generar en las personas lectoras un conocimiento general sobre lo que es gobierno abierto, sus principios y la importancia de promover esta iniciativa en el Poder Judicial de Costa Rica. Para lograr lo señalado, se procedió a analizar de manera integral, el contexto del gobierno abierto en el ámbito internacional, nacional e institucional; a partir de información que fue recabada por medio de entrevistas dirigidas a las personas que integran el Grupo de Trabajo Especial de Gobierno Abierto del órgano judicial y fuentes literarias avocadas a la temática de interés. A raíz de esto, se logró identificar la existente alineación entre el concepto, sus principios y los objetivos estratégicos comprendidos en el Plan Estructural Institucional y la misión del Poder Judicial, mismos que a su vez se muestran congruentes con los pilares del desarrollo del Plan Nacional de Desarrollo de la Administración Solís Rivera. Así mismo, producto de la investigación realizada, se lograron reconocer una serie de limitaciones en la institución que no permiten una generación oportuna de las iniciativas, producto de obstáculos como un presupuesto reducido y la falta de coordinación y comunicación entre los actores institucionales a cargo de este tema. Por lo anterior, el objetivo principal de este proyecto, consistió en fortalecer la capacidad institucional del Poder Judicial por medio de una estrategia de atracción de Cooperación Internacional, para la implementación de la práctica de gobierno abierto y sus tres pilares: transparencia, participación y colaboración, con la finalidad de proveer recursos oficiales para el desarrollo, durante el periodo 2016-2018. Se determinaron como acciones prioritarias, el fortalecimiento de las acciones realizadas por el Grupo de Trabajo Especial de Gobierno Abierto, para la consecución y reconocimiento de más iniciativas, el reconocimiento de posibles aliados para generar acciones de cooperación internacional y el acercamiento e involucramiento de la población usuaria para el desarrollo integral del tema en la institución, es decir, la alineación de los principios de Gobierno Abierto y los Objetivos Estratégicos del Poder Judicial.

This research work seeks to generate in the readers a general knowledge of what open government is, its principles and the importance of promoting this initiative in the Judicial Branch of Costa Rica. To achieve this, the context of open government at the international, national and institutional level was analyzed in a comprehensive manner, based on information gathered through interviews with members of the Special Working Group on Open Government of the judiciary and literary sources devoted to the topic of interest. As a result, it was possible to identify the existing alignment between the concept, its principles and strategic objectives included in the Institutional Structural Plan and the mission of the Judicial Branch, which in turn are congruent with the pillars of development of the National Development Plan of the Solis Rivera Administration. Likewise, as a result of the research conducted, it was possible to recognize a series of limitations in the institution that do not allow a timely generation of initiatives, due to obstacles such as a reduced budget and the lack of coordination and communication between the institutional actors in charge of this issue. Therefore, the main objective of this project was to strengthen the institutional capacity of the Judiciary through a strategy of attracting international cooperation for the implementation of the practice of open government and its three pillars: transparency, participation and collaboration, in order to provide official resources for development during the period 2016-2018. Priority actions were determined as the strengthening of the actions carried out by the Open Government Special Working Group, for the achievement and recognition of more initiatives, the recognition of potential allies to generate international cooperation actions and the approach and involvement of the user population for the comprehensive development of the subject in the institution, that is, the alignment of the principles of Open Government and the Strategic Objectives of the Judiciary.
