Principios Rectores del Derecho de Filiación en Honduras en los años 2019-2020

Abstract

La filiación en el derecho de familia es una institución de suma importancia, puesto que a partir de ella se origina una constelación de derechos y obligaciones (alimentos, herencia, patria potestad, guarda y cuidado, etc.), por otra parte, construye parte de la personalidad del individuo, ya que, este conoce su origen biológico y de igual manera, es vital en la consolidación de la identidad personal. Por el interés de profundizar en dicha institución jurídica, el presente trabajo tiene como tema de investigación “Principios rectores del derecho de filiación en Honduras en los años 2019-2020”, el cual se enmarca en realizar un análisis sobre la existencia y desarrollo de los principios de la filiación en las diferentes normas nacionales y hacer derecho comparado con leyes de otros países, con el fin de poder determinar la situación actual, desarrollo, falencias dentro del cuerpo legal y, de esta manera, se comprenderá la esfera de protección que existe, así como, las situaciones no protegidas por el derecho en el ordenamiento jurídico actual. La investigación inicia con un recorrido sobre los antecedentes históricos de los principios rectores de la filiación, que tienen su origen en el derecho romano, la importancia de su regulación en el código napoleónico y cómo se desarrolla en el ordenamiento jurídico contemporáneo. Una vez determinados y reconocidos los principios institucionales de filiación, se procede al desarrollo de cada uno de ellos para lograr una mayor compresión y efectuar un análisis crítico y comparativo de los mismos. La filiación al hundir sus raíces en la naturaleza misma del ser humano, como se expresa ut supra, también ha tenido un desarrollo correlativo al aspecto social y cultural de la civilización. El problema por dilucidar con la presente investigación es identificar cuáles son los principios institucionales de la filiación en Honduras, cómo han sido desarrollados en el ordenamiento jurídico y si garantiza derechos a nuevos grupos (antes invisibilizados) mediante la actualización de la norma; también si contempla una posible 8

solución a una multiparentalidad y si hay una adaptación con los nuevos adelantos científicos con las técnicas de reproducción asistida. Es por ese motivo, que el objetivo del presente trabajo es analizar la influencia de los principios que rigen el derecho de filiación en el funcionamiento del sistema legal de filiación y paternidad en Honduras en el periodo comprendido entre los años 2019-2020. Se realizará un análisis del aspecto teleológico de los principios rectores del derecho de filiación en Honduras presente en las diversas leyes que regulan dicha institución, mediante una metodología descriptiva y explicativa.

Filiation in family law is an institution of the utmost importance, since from it originates a constellation of rights and obligations (support, inheritance, parental authority, guardianship and care, etc.), on the other hand, it builds part of the personality of the individual, since he knows his biological origin and in the same way, it is vital in the consolidation of personal identity. Due to the interest of delving into said legal institution, the present work has as its research theme "Guiding principles of the right of filiation in Honduras in the years 2019-2020", which is framed in carrying out an analysis on the existence and development of the principles of affiliation in the different national norms and make law compared with the laws of other countries, in order to be able to determine the current situation, development, shortcomings within the legal body and, in this way, the sphere of protection that exists will be understood , as well as situations not protected by law in the current legal system. The investigation begins with a tour of the historical background of the guiding principles of filiation, which have their origin in Roman law, the importance of its regulation in the Napoleonic code and how it is developed in the contemporary legal system. Once the institutional principles of affiliation have been determined and recognized, each of them is developed in order to achieve greater understanding and carry out a critical and comparative analysis of them. The affiliation by sinking its roots in the very nature of the human being, as expressed ut supra, has also had a correlative development to the social and cultural aspect of civilization. The problem to be elucidated with this research is to identify what are the institutional principles of affiliation in Honduras, how they have been developed in the legal system and if it guarantees rights to new groups (previously invisible) by updating the norm; also if you contemplate a possible 8

solution to multiparenthood and if there is an adaptation with the new scientific advances with assisted reproduction techniques. It is for this reason that the objective of this work is to analyze the influence of the principles that govern the right of filiation in the functioning of the legal system of filiation and paternity in Honduras in the period between the years 2019-2020. An analysis of the teleological aspect of the guiding principles of the right of filiation in Honduras present in the various laws that regulate said institution will be carried out, through a descriptive and explanatory methodology.
